These Terms and Conditions ("Terms") govern the relationship between Stephenson Adventures ("Company", "we", or "us") and all persons ("customer", "you", or "your") using or booking any of our services, including Day Tours, Safaris, and Shuttle Services.

By booking, purchasing, or using any of our services, you agree to be bound by these Terms and any specific conditions associated with the service.

1. DEFINITIONS 

1.1 "Service(s)" refers to the Day Tours, Safaris, and Shuttle Services offered by the Company. 

1.2. "Agreement" refers to these Terms and Conditions as well as any other written agreement between the parties. 

1.3. "Force Majeure" refers to unforeseen events beyond the Company’s control, including but not limited to natural disasters, strikes, civil unrest, pandemics, or government restrictions.

 

2. BOOKINGS
2.1 All bookings must be made through our website, phone, email, or Whatsapp. 

2.2 A booking confirmation will be sent to you via email, or the platform used to book. All bookings are subject to availability and are confirmed only upon receipt of full payment or deposit (where applicable).

2.3 The booking confirmation must be presented on the day of service.

2.1 It is the customer's responsibility to ensure all details in the booking confirmation are correct.

 

3. PAYMENT

3.1 Full payment is required at the time of the booking unless a written confirmation from the company about a different arrangement has been received.

3.2 Payments can be made through the following methods: credit card, bank transfer, cash, and online payment.

3.3 All prices are quoted in South African Rand (ZAR). Prices are subject to change without prior notice, and confirmed bookings will not be affected by subsequent price changes.

 

4. CANCELLATION POLICY

4.1 Shuttle Services:

  • Cancellations made more than 24 hours before the scheduled service will receive a full refund.
  • Cancellations made within 24 hours will incur a cancellation fee amounting to 100% of the reservation amount.
  • Failure to appear at the agreed pick-up or start point at the agreed time and date will be considered a no-show, and no refund will be issued.

4.2 Day Tours:

  • Cancellations made more than 24 hours before the scheduled service will receive a full refund.
  • Cancellations made within 24 hours will incur a cancellation fee amounting to 100% of the reservation amount.
  • Failure to appear at the agreed pick-up or start point at the agreed time and date will be considered a no-show, and no refund will be issued.

4.3 Wildlife Safaris:

  • Cancellations made more than 90 days prior to the safari will incur a cancellation fee amounting to 10% of the reservation amount for fees and handling. 
  • Cancellations made between 60 to 90 days prior to the safari will incur a cancellation fee amounting to 25% of the reservation amount.
  • Cancellations made between 30 to 60 days prior to the safari will incur a cancellation fee amounting to 50% of the reservation amount.
  • Cancellations made within 30 days will be charged the full fare and will not be eligible for a refund.

 

5. BOOKING MODIFICATIONS

5.1 Changes to bookings (date, time, number of participants, or itinerary) can be made without charge up to 14 days prior to the scheduled service, subject to availability.

5.2 Changes made between 7- and 14-days prior may incur a fee based on availability and any additional costs.

5.3 Changes made within 6 days of the service may not be accommodated and are subject to cancellation fees as outlined above.

 

6. NO-SHOW POLICY

6.1 If a guest fails to arrive at the designated meeting point within 15 minutes of the scheduled departure time without prior notice, the reservation will be considered a no-show. The full fare will be charged, and no refund will be provided.

 

7. LIABILITY

7.1 Personal Risk: Participation in our services, including tours, safaris, and shuttle transport, involves inherent risks. By participating, the Client accepts these risks and agrees to hold the Company harmless from any injury, loss, or damage, except where caused by gross negligence or willful misconduct by the Company.

7.2 Third-Party Liability: We use third-party service providers (such as lodges, transportation companies, and guides) where necessary. We are not liable for any act, omission, or negligence on the part of these providers.

7.3 Client Responsibility: Clients must ensure they are in suitable physical and mental condition to participate. We are not liable for injuries resulting from a failure to disclose medical conditions or failure to follow safety guidelines provided by the Company or service providers.

7.4 Travel Insurance: We highly recommend that all Clients obtain comprehensive travel and medical insurance, covering cancellations, loss of personal belongings, accidents, and medical emergencies..

7.5 Loss or Damage to Personal Property: The Company is not liable for the loss or damage of personal belongings during the provision of services. Guests are encouraged to keep their belongings secure and to report any loss to our staff immediately.

 

8. MISSED FLIGHTS

8.1 Timeliness and Responsibility: It is the Client’s sole responsibility to ensure they have allowed sufficient time to arrive at the airport for their flight, taking into consideration potential delays such as traffic, weather conditions, and any other unforeseen events. 

8.2 No Liability for Missed Flights: The Company shall not be held liable for any missed flights, connections, or additional expenses incurred by the Client as a result of delays during any of our services, including but not limited to Day Tours, Safaris, or Shuttle Services. 

8.3 Advised Travel Planning: Clients are advised to plan conservatively and allow for extra travel time when booking shuttle services or tours that coincide with their flight schedules.

 

9. TRANSPORT AND TIMELINESS 

9.1 Shuttle Services: The Company will make every reasonable effort to ensure the shuttle services operate on time. However, we are not liable for delays caused by traffic, weather, or other unforeseen circumstances. It is the Client’s responsibility to ensure timely arrival at the agreed pick-up points.

9.2 Luggage: Clients are responsible for the safety of their luggage. We are not liable for any loss or damage unless caused by our gross negligence.

 

10. CONDUCT AND BEHAVIOR

10.1 Clients are expected to act responsibly and respectfully towards guides, drivers, and other participants. 

10.2 We reserve the right to remove any Client who engages in abusive, illegal, or disruptive behavior without a refund.

 

11. FORCE MAJEURE

11.1 The Company shall not be held liable for delays, cancellations, or any inability to fulfill its obligations due to events beyond its control, including but not limited to weather conditions, natural disasters, strikes, pandemics, or government restrictions.12. PHOTOGRAPHY AND MEDIA RELEASE

12.1 By participating in our services, you agree to allow the Company to use photographs or videos taken during tours and safaris for promotional purposes. If you do not wish to appear in such media, please notify the Company in writing prior to your service date.

 

13. PRIVACY AND DATA PROTECTION

13.1 The Company will protect your personal data in accordance with South Africa's Protection of Personal Information Act (POPIA). Your data will not be shared with third parties without your consent, except where required by law or to fulfill the service you booked.

 

14. INDEMNITY

14.1 The Client agrees to indemnify and hold harmless the Company, its employees, and affiliates from any claims, losses, damages, or expenses arising from the Client’s actions, negligence, or non-compliance with these Terms.

 

15. DISPUTES AND GOVERNING LAW

15.1 These Terms and Conditions shall be governed by the laws of the Republic South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of South Africa.

15.2 Any dispute arising from these Terms shall first be resolved through good faith negotiation. If no resolution is reached, the dispute shall be submitted to the jurisdiction of the courts of South Africa.

 

16. CHANGES TO TERMS AND CONDITIONS

16.1 Stephenson Adventures reserves the right to update or modify these Terms and Conditions at any time. Changes will be communicated through our website or via direct communication with clients.

16.2 Continued use of our services after changes are made constitutes your acceptance of the revised terms.

 

17. DISCLAIMER

17.1 While every effort is made to provide accurate information, the Company cannot guarantee the completeness or accuracy of information related to tours, services, or destinations. The Company reserves the right to make necessary changes to itineraries or services without notice to ensure client safety or in response to changing circumstances.

 

18. CUSTOMER COMPLAINTS

18.1 Should you have any complaints or issues during your service, please notify our staff immediately to allow us the opportunity to resolve the matter.

18.2 Formal complaints can be directed to admin@stephensonadventures.co.za , and we will respond within 5 business days.

 

19. ACCEPTANCE OF TERMS

19.1 By booking or participating in any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Child Policies for Shuttle Services, Day Tours, and Safaris

Shuttle Services and Day Tours:

Children of all ages are welcome on all the services we offer. Bookings for our multiday safaris are strictly subject to the availability of child-friendly accommodation at the time of request.

  1. Child Safety
  • All children must wear seat belts during shuttle rides. Booster and child seats are available upon request for children under 4 years old or older.
  1. Supervision
  • Parents or guardians must always supervise children during tours and activities.
  1. Pricing
  • Children aged 6 to 12 years receive a 50% discount on day tours.
  • Children aged 0 to 5 years will not be charged.
  • Children above the age of 12 will pay full adult rate.
  1. Behavior Expectations
  • We ask that all children behave respectfully during tours to ensure a pleasant experience for everyone.
  1. Special Needs
  • If your child has special needs, please inform us in advance so we can accommodate them appropriately.

Safari Policies:

  1. Age Restrictions:
    • Different safari lodges may have varying age restrictions for children. It is essential to check with us regarding the specific policies of the lodge where your safari is booked.
  2. Safety Considerations:
    • Children under the age of 12 may not be permitted on certain safari activities due to safety concerns. This includes but is not limited to walking safaris and certain game drives.
    • It is the responsibility of parents or guardians to ensure that their children adhere to safety guidelines provided by the safari guides.
  3. Special Arrangements:
    • If you are traveling with children, please inform us at the time of booking so we can make any necessary arrangements and ensure a safe and enjoyable experience for everyone.
