TERMS & CONDITIONS

Welcome to Stephenson Adventures (Pty) Ltd. By booking a tour, safari, transfer, or any other service with us, you agree to be bound by these Terms & Conditions.

1. Service

Stephenson Adventures (Pty) Ltd provides guided tours, safaris, transport services, and travel experiences within South Africa and Southern Africa.

2. Bookings & Payments

– All bookings are subject to availability.
– Bookings are only confirmed once payment has been received and confirmed.
– Payments may be made via Bokun, PayPal, EFT, TripAdvisor, or any other approved payment method.
– Prices are quoted in the applicable currency and may be subject to change without prior notice until a booking is confirmed.

3. Cancellation Policy 

Shuttle Services
– Cancellations made more than 24 hours before the scheduled service will receive a full refund.
– Cancellations made within 24 hours of the scheduled service will incur a 100% cancellation fee.
– No-shows are non-refundable and will be charged the full booking amount.

Day Tours
– Cancellations made more than 24 hours before the scheduled tour will receive a full refund.
– Cancellations made within 24 hours of the scheduled tour will incur a 100% cancellation fee.
– No-shows are non-refundable and will be charged the full booking amount.

Wildlife Safaris
– Cancellations made more than 90 days before departure will incur a 10% cancellation fee.
– Cancellations made between 60 and 90 days before departure will incur a 25% cancellation fee.
– Cancellations made between 30 and 60 days before departure will incur a 50% cancellation fee.
– Cancellations made less than 30 days before departure are non-refundable and will be charged the full booking amount.

4. Changes to Bookings 

– Any request to amend a booking is subject to availability.
– Additional costs may apply when changes are requested after confirmation.
– Stephenson Adventures reserves the right to alter itineraries where necessary due to weather conditions, safety concerns, operational requirements, or circumstances beyond our control.

5. Liability & Assumption of Risk 

Participation in tours, safaris, and related activities involves inherent risks. By booking or participating in any service, you acknowledge and agree to the following:

Assumption of Risk

You understand that activities may involve travel risks, exposure to wildlife, environmental conditions, road travel, and physical activity. Participation is voluntary, and you assume responsibility for any associated risks.

Limitation of Liability

To the fullest extent permitted by law, Stephenson Adventures (Pty) Ltd, its employees, guides, contractors, and affiliates shall not be held liable for:

– Personal injury, illness, or death
– Loss, theft, or damage to personal property
– Delays caused by traffic, weather, government actions, or third parties
– Missed connections, accommodation, or travel arrangements
– Any indirect, incidental, or consequential damages

Third-Party Providers

Certain services may be provided by third-party operators, accommodation providers, transport companies, or activity providers. Stephenson Adventures is not responsible for their acts, omissions, negligence, or service failures.

Health & Fitness

Guests are responsible for ensuring they are physically and medically fit to participate in their chosen activity. Any medical conditions, disabilities, allergies, or special requirements must be disclosed before booking.

Compliance with Instructions

All guests agree to follow the instructions provided by guides, drivers, and staff. Failure to do so may result in removal from the tour or activity without refund.

Indemnity

Guests agree to indemnify and hold harmless Stephenson Adventures (Pty) Ltd from any claims, liabilities, damages, losses, or expenses arising from their participation in any tour, safari, transfer, or related service.

6. Minors 

– Minors may not make bookings independently.
– Guests under the age of 18 must be accompanied by a parent, legal guardian, or responsible adult.
– The accompanying adult accepts responsibility for the minor’s safety and conduct.

7. Safety

Stephenson Adventures prioritises the safety of its guests and staff.

– Vehicles are maintained in accordance with applicable regulations.
– Activities are conducted according to safety guidelines and operational standards.
– Guests are required to follow all safety instructions provided.

8. Intellectual Property 

All content on the website, including text, images, logos, branding, graphics, and other materials, remains the property of Stephenson Adventures unless otherwise stated.

No content may be copied, reproduced, distributed, or used without prior written permission.

9. Privacy 

Your use of our services is also governed by our Privacy Policy and Cookie Policy, which form part of these Terms & Conditions.

10. Governing Law 

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the South African courts.
